A prominent corner in downtown Charleston soon will undergo a big change.
Moe’s Southwest Grill at King and Calhoun streets closed Jan. 21 after a settlement was reached recently in a lease dispute.
The high-profile property, where Moe’s operated for 20 years, will become a Refuel convenience store, not a gas station, according to Refuel CEO Mark Jordan.
Jordan expects to retrofit the 3,000-square-foot space near the College of Charleston and Marion Square by the summer.
“It will have everything we have at other Refuel sites except gas,” Jordan said. “That’s a great location, and I’m so happy to get it.”
Property owner Kenneth Davenport said he and the Moe’s franchisee, Quality Fresca I LLC, reached a joint resolution Jan. 20. Moe’s closed the next day.
Davenport declined to discuss details of the settlement but said Moe’s must vacate the property by Jan. 31.
“It’s nice to put this one to bed,” he said Jan. 24.
A representative of Moe’s did not immediately respond for comment.
Work crews removed the building’s signage Monday while employees packed up wares inside the restaurant.
The tenant had been in litigation with Davenport after a representative of the restaurant said on Aug. 6, 2020, the company would not exercise its option for a new lease arrangement, according to Charleston County court documents.
The franchisee said on Sept. 3, 2020, it wanted to renew the lease under new terms, but Davenport had already secured a real estate firm to find a new tenant and rejected the franchisee’s offer.
The lease expired Sept. 30, 2020.
In November of that year, the franchisee appealed a magistrate judge’s ruling ordering Moe’s to vacate the building.
A circuit court judge ruled against the tenant last March and denied a motion to reconsider the decision in April. The tenant then appealed the case to the South Carolina Court of Appeals, where the case remained until the current resolution was reached.
Moe’s opened on the site in 2002 as the first restaurant in the Charleston area for the Atlanta-based chain.
Charleston-based Refuel currently operates 175 stores in South Carolina, North Carolina, Arkansas, Mississippi and Texas. The company recently received a $511 million injection of new capital to further expand.
In the Charleston area, Refuel has two stores each in Mount Pleasant and Goose Creek and one each on Daniel Island, Sullivan’s Island, West Ashley, Cainhoy and the Summerville area.
Three others are in the works on Folly Road on James Island, on Clements Ferry Road near Beresford Run and on Midtown Avenue at Hungryneck Boulevard in Mount Pleasant, a block away from another store at Venning Road.
Jordan recently said the Midtown site could be developed into a new store, sold or turned into a stand-alone car wash location.

All Georgetown County Library branches will be closed Saturday.
Berkeley County government offices, the courthouse, and all convenience centers will close at 3:00 p.m.
Berkeley Animal Center, Cypress Gardens, and all Berkeley County Library branches will also close early.
Dorchester County Administrative Offices, Dorchester County Circuit, Family and Magistrate Courts, and Dorchester County Libraries will close at 3:00 p.m. on Friday.
All Dorchester County Convenience Sites and county parks will close at 3:00 p.m. Friday and will reopen at noon on Saturday.
Colleton County will close all offices at 1:00 p.m. Friday Convenience Centers will close at 1:00 p.m. Friday and open again at noon on Saturday.
The Berkeley County Museum and Old Santee Canal Park will both be closed Friday and Saturday.
Patriots Point Naval & Maritime Museum will be operating under adjusted hours on Friday, January 21 and Saturday, January 22. The museum will close Friday at 2 p.m., with the last ticket sold at 12:30 p.m. The museum will reopen at 10 a.m. on Saturday, an hour later than normal.
Crowfield Golf Club will only be open for lunch on Friday. The golf course and driving range will close at 3:00 p.m. and may open for lunch Saturday at 11:00 a.m.
